Công văn đề nghị Sở Kế hoạch và Đầu tư gửi về Ủy ban nhân dân tỉnh và Sở Tài nguyên và Môi trường trước 16 giờ ngày 16 tháng 03 năm 2021.
sau khoản thời gian có ý kiến của Sở Kế hoạch và Đầu tư, Sở Tài nguyên và Môi trường hoàn thành các thủ tục pháp lý có liên quan khu đất 83,66 ha, tham mưu Ủy ban nhân dân tỉnh, Ban cán sự đảng Ủy ban nhân dân tỉnh báo cáo Thường trực Tỉnh ủy việc giải quyết thuê đất đối với dự án sân chơi golf và Dịch vụ Hương Sen tại thị trấn Phước Hải, huyện Đất Đỏ, thời gian đã đi vào hoạt động trước ngày 20 tháng 03 năm 2021.
Nội dung công văn cũng nêu rỏ yêu cầu Sở Kế hoạch và Đầu tư, Sở Tài nguyên và Môi trường khẩn trương thực hiện, báo cáo đúng thời hạn. Nếu quá thời hạn nêu trên, thì Lãnh đạo Sở Kế hoạch và Đầu tư, Sở Tài nguyên và Môi trường chịu trách nhiệm trước Ban cán sự đảng Ủy ban nhân dân tỉnh và Thường trực Tỉnh ủy.
Trước đó, ngày 22/2/2021, Ủy ban nhân dân cũng đã có Công văn số 1465 về sự giao Sở Tài nguyên và Môi trường chủ trì phối hợp với Sở Kế hoạch và Đầu tư và các sở ngành có liên quan rà soát, khẳng định tính pháp lý việc cho phép tiếp tục triển khai dự án, việc cho thuê khu đất 83,66 ha không thông hình thức đấu giá, thống nhất phương án xử lý, tham mưu Ủy ban nhân dân tỉnh giải quyết theo đúng chuẩn mực pháp luật. Thời gian hoàn tất trong tháng 02 năm 2021.
Lập thủ tục thu hồi, giao khu đất 4,7 ha (thuộc phía biển) cho Ủy ban nhân dân huyện Đất Đỏ quản lý, làm bãi tắm công cộng và chịu trách nhiệm trước pháp luật trong những công việc quản lý, tôn tạo, khai thác khu đất.
Nội dung Công văn số 1465 cũng giao Sở Kế hoạch và Đầu tư thực hiện ý kiến chỉ đạo của Ban cán sự Đảng UBND Tỉnh tại thông tin số 1852 TB/BCSĐ nêu trên, khẳng định tính pháp lý việc cho phép tiếp tục triển khai dự án, gửi Sở Tài nguyên và Môi trường tổng hợp.
Thời gian hoàn tất trước ngày 25 tháng 02 năm 2021.
Dù vậy, sau ngày Sở Kế hoạch và Đầu tư nhưng vẫn không hoàn tất và đến mức Sở Tài Nguyên Môi trường đôn đốc lần 2 qua văn bản số 1135/STNMT-CCQLĐĐ ngày 08 tháng 03 năm 2021.
Dự án nghìn tỷ kéo dài hai mươi năm
Tháng 3/2020, theo Quyết định số 528/QĐ-UBND, UBND tỉnh Bà Rịa – Vũng Tàu đã chấp thuận cho cty Cổ phần Hương Sen thực hiện đầu tư dự án sân chơi golf và Dịch vụ Hương Sen tại thị trấn Phước Hải, huyện Đất Đỏ với diện tích dao động 88,36 ha và tổng vốn đầu tư là 1.051 tỷ đồng.
Quy mô dự án 88,36 ha gồm xây dựng một sân chơi golf 18 lỗ và các dịch vụ nghỉ dưỡng, giải trí giải trí, phục vụ giải trí cho khoảng 820 lượt khách/ngày đêm.
Dự kiến, dự án đã đi vào hoạt động thủ tục pháp lý đầu tư vào quý 1/2021 và đi vào hoạt động kinh doanh vào quý 1/2023. Thời hạn hoạt động của dự án là 50 năm, kể từ ngày lựa chọn chủ trương đầu tư.
UBND tỉnh sẽ chấm dứt hiệu lực chủ trương của dự án trong trường hợp nhà đầu tư không triển khai đúng tiến độ đã cam đoan theo quy định của Luật Đầu tư.
Thực tế, dự án sân chơi golf và dịch vụ Hương Sen được thỏa thuận địa điểm từ những năm 2001 trên diện tích hơn 91ha, tại thị trấn Phước Hải với tổng vốn đăng ký 800 tỷ đồng. Công trình sân chơi golf và các hạng mục trong sân golf bao gồm sân golf 18 lỗ, khách sạn 5 sao, biệt thự và khu giải trí, khu nghỉ dưỡng ven biển.
Năm 2006, tỉnh phê duyệt điều chỉnh quy hoạch chi tiết 1/1.000 và chấp thuận điều chỉnh diện tích còn lại 90,7 ha.
Đến năm 2008, UBND tỉnh chính thức cấp giấy chứng nhận đầu tư cho dự án với vốn đầu tư 800 tỉ đồng, diện tích 97,4ha, tiến độ thực hiện dự án từ quý 4/2008 đến năm 2013.
trong các công việc thực hiện, dự án không ngừng nghỉ phát triển chậm độ và bị đưa vào danh sách tham khảo thu hồi vào năm 2017.
Đến tháng 11/2017, UBND tỉnh đã có văn bản về sự chấm dứt hoạt động dự án sân golf và dịch vụ Hương Sen. lý do thu hồi là do Dự án chậm tiến độ triển khai so với Giấy chứng nhận đầu tư đã cấp (thời gian bắt đầu làm 2008, hoàn tất năm 2013), không chứng minh được khả năng thực hiện dự án.
tuy thế, tháng 5/2018, chủ đầu tư cty Cổ phần Hương Sen có đơn xin được tiếp tục thực hiện dự án và cam kết đủ tài chính để hoàn tất theo tiến độ.
Tháng 12/2018, UBND tỉnh đã có văn bản báo cáo Thường trực Tỉnh ủy xin ý kiến cho phép doanh nghiệp Hương Sen tiếp tục thực hiện dự án và được đồng ý.
Tuy nhiên, từ đó đến nay dự án gặp phải khó khăn trong công việc cho chủ đầu tư thuê đất thực hiện do chưa có sự thống nhất của Bộ Tài nguyên và Môi trường và Bộ Kế hoạch và Đầu tư.
